1. Object
These conditions of sale aim to define the contractual relationship between La Spiniella and the buyer and the conditions applicable to any purchase made through the La Spiniella website, www.laspiniella.fr or www.laspiniella.com.br. The acquisition of a product through this site implies unreserved acceptance by the purchaser of these conditions of sale, which the purchaser acknowledges having read before placing his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the La Spiniella site, www.laspiniella.fr or www.laspiniella.com.br is not directly related to his professional activity and is limited to one strictly personal use and on the other hand have full legal capacity, allowing it to engage under these general conditions of sale.

2. Products
The products offered are those which appear on the La Spiniella website, while stocks last. La Spiniella reserves the right to modify the product range at any time. The photographs are as accurate as possible but do not bind the Seller in any way.
3. Tariffs

4. Orders and payment terms
To order, the following steps must be followed:

The prices of the products are indicated on the Site in euros.

La Spiniella reserves the right to refuse, cancel and terminate orders at any time for legitimate and legal reasons.
La Spiniella will also be entitled to refuse any order placed by a Customer with whom there is a dispute relating to the payment of a previous order as well as any order not in accordance with these GTC.
In these cases, La Spiniella will inform the Customer by telephone or by e-mail.
In the event that the Products presented on the Site are no longer available or for sale at the time of sending your order, La Spiniella must notify you promptly, and in any case, within thirty working days from the day following your order. order, the possible unavailability of the ordered products. In the event of payment of the price, La Spiniella will reimburse you for the full amount advanced for unavailable Products.
The contract is deemed concluded upon receipt by La Spiniella of the order after verification by La Spiniella of the accuracy of the data relating to the order.
After validation of your order, an acknowledgment of receipt will be sent by email to the Customer, containing a summary of the order information (essential characteristics of the product, price, means of payment, right of withdrawal, delivery times and costs).
The Site offers payment by Credit Card and Paypal. When the order is finalized, La Spiniella confirms the payment by sending the Customer a summary email.
The prices displayed on the site are expressed in euros, all taxes included (VAT not applicable, article 294B of the CGI). The costs of packaging, order processing and shipping are indicated before validation of the order.
La Spiniella may modify the prices of the Products at any time and without notice, in particular due to changes in the economic, legislative and fiscal framework. The Products are invoiced on the basis of the price in force when the Customer places an order.
The Products remain the full and entire property of the company La Spiniella until full receipt of the price of each order.
Payment for purchases is made via the secure Stripe platform.
5. Retention of title
The company La Spiniella retains full and entire ownership of the products sold until full payment of the price, in principal, costs and taxes included.
6. Withdrawal
Under Article L121-20 of the Consumer Code, the buyer has a period of (14) fourteen working days from the delivery of their order to exercise his right of withdrawal and thus return the product. to the seller for exchange or refund without penalty, with the exception of return costs.
When the fourteen-day period expires on a Saturday, Sunday or a public holiday, it is extended until the next working day. Products returned incomplete, degraded or soiled by the buyer will not be taken back.
Product refunds will be made within a maximum period of 30 days after receipt by it of said products.
Exceptions to the right of return:

7. Delivery
Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. Orders are made by La Poste via COLISSIMO with signature. Delivery times are only indicative; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. La Spiniella can provide the buyer with the tracking number of his parcel by e-mail. The buyer is delivered to his home by his postman. If the buyer is absent, he will receive a calling card from his postman, which allows him to collect the products ordered at the nearest post office or at a relay point, during a period indicated by the postal services. . The risks associated with transport are the responsibility of the purchaser from the moment the items leave the premises of the company La Spiniella. The buyer is required to check, in the presence of the La Poste employee or the delivery person, the condition of the packaging of the goods and their contents on delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.
8. Guarantee
All the products supplied by the company La Spiniella benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code. In the event of non-conformity of a product sold, it may be returned to La Spiniella, which will take it back, exchange it or reimburse it. All complaints, requests for exchange or reimbursement must be made by post to the following address: La Spiniella, 75 Avenue du Marechal Foch, 78100 Saint Germaine en Laye within thirty days after delivery.
9. Liability
La Spiniella, in the distance selling process, is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, interruption of service, or other unintentional problems.
10. Intellectual property

12. Settlement of disputes
These distance selling conditions are subject to French law. For all disputes or litigation, the competent court will be that of Nanterre.
